Terms and Conditions ("Terms")

Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the Zantac Litigation Client Repository and Lexitas Record Retrieval Services (the "Service") operated by Lexitas ("us", "we", or "our").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

Billing

1.1 Charges
The rates set for the Zantac Litigation were set and agreed to by the Census Team. These rates include a Base Fee for services rendered, a per page fee for pages produced. In addition, any prepaid costs associated with obtaining the record will be charged as outlined in 1.5 Collections.

1.2 Split Billing Limitations
The program allows for split billing with the Defense on all Proof of Use and Proof of Injury (“POU” and “POI”) record requests placed through Lexitas. Should you place any other records requests through Lexitas, you will be responsible for 100% of the charges.

1.3 Delivery
A statement outlining all invoices generated the preceding month will be provided by the 5th business day of the following month by email.

1.4 Remittance
Remittance is due 30 days from receipt of statement as outlined in 1.3. Lexitas accepts payments via ACH, Credit Card and check.

1.5 Collections
If you exceed the 30 day Remittance policy as outlined in 1.4, a surcharge will be added to the prepaid expenses. At 30 days past payment due date, a 10% surcharge will be added. At 60 days a 25% surcharge will be added. At 90 days, the account will be deactivated and will not be reinstated until the account is brought current.

Turnaround

Our Service will make every effort to keep turnaround times to a minimum from order placed to publishing the records.

2.1 Pending Client Response/Hold
Lexitas tracks the number of days an order is on hold or pending client response, reducing the count from the overall turnaround total. To keep turnaround times to a minimum it is your responsibility to respond to questions that arise as soon as possible.

Release of Records to LMI

3.1 Plaintiff Opportunity to Review
POU and POI records will be published on the firm’s Zantac Litigation Repository with a nightly email going to the parties of your designation of published records. Plaintiff will have fourteen (14) days to review the records prior to the release to LMI. If no approval is received by the end of business on the fourteenth day, the records will be released to LMI to be published to Defense.

3.2 Early release to LMI
If you approve the record to be released prior to the expiration of the Review Period, the record will be sent on the following business day.

3.3 Indemnification
Once the record has been successfully transferred to LMI, Lexitas assumes no responsibility for the actions taken with that record by LMI. This includes, but is not limited to, timeline to publish to Defense, destruction of record, etc.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least fifteen (15) days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
